DHAKA: The High Court on Thursday (June 28) rejected a plea of war crime convict Delawar Hossain Sayedi, seeking division facilities in jail.
An HC bench of Justice Syed Mohammad Dastagir Hossain and Justice Md Iqbal Kabir passed the order.
Attorney General Mahbubey Alam moved for the state while Senior Lawyer Khandaker Mahbub Hossain moved for Sayeedi. Barrister Tanvir Ahmed Al Amin accompanied him. The hearing took place for two days.
The writ petition seeking the jail division facilities was filed with the court on Sunday (June 28).
“He (Sayeedi) needs treatment and he can get division-2, as per the jail code. He is suffering from Diabetes and heart disease. Six rings have been implanted in his heart,” Barrister Tavir told the court.
In reply, the attorney general said, “A writ can’t run on side of any war crime accused, as per the Article- 47 (A) (2). The constitution has bar (regarding this). Therefore, the writ (is) not maintainable.”
On February 28 in 2013, the International Crimes Tribunal (ICT)-1 sentenced the Jamaat leader to death for crimes against humanity during the Liberation War in 1971.
Sayeedi filed an appeal on March 28 in 2013, against the tribunal judgment.
Following plea from Sayeedi seeking review of the judgment, the apex court on September 17, 2014 commuted his sentence of death to imprisonment until death.
