Contempt of Court Act`13 canceled

DHAKA: The High Court canceled the Contempt of Court Act-2013 terming it illegal and contradictory to the constitution.

An HC bench comprising Justice Kazi Rezaul Haq and Justice ABM Altaf Hossain passed the order Thursday saying that eight provisions of the act might curtail the court power.

Deputy Attorney General Biswajit Roy confirmed the matter to banglanews.

On April 3, HC issued a rule asking the government to explain in 10 days why the eight provisions of Contempt of Court Act, 2013, which allegedly curtail the court power, should not be declared unconstitutional.

The rule was issued following a writ petition moved by advocate Manzill Murshid saying the eight provisions are illegal and unconstitutional.

The provisions are 4, 5, 6, 7, 9, 10, 11, 13 (2).

According to the provisions, the court cannot issue any summons against any government official if they have committed contempt of court and contempt of court cases against them become ineffective just after their retirement.
