DHAKA: The Supreme Court upheld Chamber Judge’s decision that stayed the order of High Court clearing the way for BNP aspirants Iqbal Hasan Mahmud Tuku and Ruhul Quddus Talukder Dulu to contest in the election.
The Appellate Division bench led by Chief Justice passed the order on Wednesday (Dec 12) after hearing the EC’s appeal challenging the HC order over the candidature of the duo .
Earlier on Tuesday (Dec 11), the Chamber Judge of the Appellate Division Justice Hasan Foez Siddique stayed the HC order that cleared the way for the duo to contest in the election after hearing the EC’s appeal.
Earlier in the day, the Election Commission the appeal to the apex court challenging the candidature of the two BNP aspirants.
Earlier, the HC on Monday (Dec 10) cleared the way for BNP aspirants Tuku and Dulu to vie the election, slated for December 30.
The HC bench of Justice Sheikh Hassan Arif and Justice Razik-Al-Jalil stayed the rejection order of returning officers and asked the Election Commission to accept their nominations after hearing two writ petitions challenging the EC’s decision.
The two BNP aspirants filed writ petitions with the HC seeking its order upon the Election Commission to accept their candidature.
Earlier, the returning officers at Natore-2 and Sirajganj-2 rejected the nomination papers of Tuku and Dulu for their conviction and sentences in criminal cases.
Later, the EC rejected the appeals filed by the duo against the returning officers' decision.
