A Dhaka court today (April 6) sentenced Evaly's founding chief executive officer Mohammad Rassel, and his wife Shamima Nasrin, former chairperson of the e-commerce platform, to three years in prison each in a fraud case involving failure to deliver a purchased motorbike.
Dhaka Metropolitan Magistrate Md Minhazur Rahman issued the verdict.
Besides, both have been fined Tk 5,000 each, with an additional six months in jail in case of default.
Confirming the ruling, plaintiff’s lawyer Sakibul Islam said that the court has also issued arrest warrants for the couple, who are currently absconding.
The case was filed by Mujahid Hasan Fahim, who ordered a Yamaha R15 motorbike from Evaly on February 20, 2021, after being drawn in by the company’s flashy advertisements. Despite full payment, the product was never delivered.
After repeated follow-ups, Evaly issued a Tk 5 lakh cheque, which could not be cashed due to insufficient funds. Fahim, trusting the company’s request, refrained from depositing it immediately. However, even after multiple demands and legal notices, no refund was provided.
Fahim filed the fraud case in January 2024, leading to Sunday’s conviction of the now-fugitive Evaly executives.
